Content Upload Agreement

By uploading Content to Fet.bio, you ("Creator") agree to and are bound by this Content Upload Agreement ("Agreement"), which forms part of the Terms of Service.

1. Age Verification
By uploading Content, you confirm and warrant that:

  1. You are at least 18 years of age;

  2. Every person depicted in your Content is at least 18 years of age;

  3. You have verified the age and identity of every person depicted in your Content and hold documentation to that effect; and

  4. You maintain all records required by 18 U.S.C. § 2257 and its implementing regulations, and will make those records available upon request.

2. Consent
By uploading Content, you confirm that:

  1. Every person depicted in your Content has given their prior, express and informed written consent to: (a) being filmed, photographed or otherwise recorded; and (b) the Content being published on Fet.bio; and

  2. You hold written evidence of such consent and will provide it to Fet.bio upon request.

3. Content Ownership
By uploading Content, you confirm that:

  1. You are the owner of the Content or have all necessary rights, licences and consents to upload it to Fet.bio and grant the licences set out herein;

  2. Your Content does not infringe any third-party intellectual property rights, privacy rights or any other rights; and

  3. Your Content is not defamatory, unlawful or otherwise in violation of applicable law.

4. Licence to Fet.bio
By uploading Content, you grant Fet.bio a worldwide, non-exclusive, royalty-free licence to store, host, display, stream and transmit your Content to subscribers and potential subscribers for the duration of your account and as necessary to fulfil our obligations under our Terms of Service.

5. Prohibited Content
You may not upload Content that:

  1. Depicts or features any person under the age of 18 in any sexual context;

  2. Was created or obtained without the consent of all persons depicted;

  3. Infringes any third party's intellectual property rights;

  4. Violates any applicable law;

  5. Contains malware, viruses or other harmful code; or

  6. Violates our Zero Tolerance Policy or our Acceptable Use Policy.

6. Takedown and Removal
Fet.bio reserves the right to remove or restrict access to any Content at any time without notice if we determine, in our sole discretion, that it violates this Agreement, our Terms of Service, or applicable law.

7. Indemnification
You agree to indemnify and hold Fet.bio, Testcompany Ltd., and their respective officers, employees and agents harmless from any claims, losses, damages or expenses (including legal fees) arising from your breach of this Agreement or any misrepresentation made herein.
